General Terms and Conditions of Chalet-Hotel Bettmerhof AG
For the sake of readability, the masculine form has been used in the text; nevertheless, the information applies to members of both genders.
Scope of Application
Contracting Parties
These General Terms and Conditions (hereinafter “GTC”) apply to the business relationships and lodging services provided by Chalet-Hotel Bettmerhof AG, Bettmeralp (hereinafter “Hotel”).
The Hotel’s contracting party is, in principle, the natural or legal person who makes a binding reservation for the relevant service with the Hotel or enters into a corresponding contract with the Hotel (hereinafter “Contracting Party”). This may include, in particular, the guest themselves, a tour operator, a travel agency, a travel agent, or any other business partner of the Hotel.
A “Guest” is defined as the person who actually makes use of the lodging service booked through the Hotel.
For bookings made through a tour operator, a travel agency, a travel intermediary, or another booking partner, additional or differing contractual and booking terms and conditions of the respective booking partner may apply in addition to these General Terms and Conditions. The terms agreed upon between the booking partner and the guest shall govern the contractual relationship between them.
The contractual relationship between the hotel and the respective contracting party is governed by the terms agreed upon between them and, to the extent applicable, these General Terms and Conditions. In the event of any conflict, terms agreed upon individually between the hotel and the contracting party shall take precedence over these General Terms and Conditions.
These General Terms and Conditions also apply to the guest’s use of the services provided by the hotel, to the extent provided for by their content and the circumstances of the respective contractual relationship.
Incorporation of the General Terms and Conditions
The General Terms and Conditions are made available to the contracting party in an appropriate form prior to or, at the latest, upon conclusion of the contract. By making a binding reservation or concluding the contract, the contracting party acknowledges the General Terms and Conditions applicable to the respective contractual relationship.
For bookings made through tour operators, travel agencies, travel brokers, or other booking partners, the contractual and booking terms agreed upon with the respective booking partner shall apply in addition to these General Terms and Conditions. To the extent that the booking partner acknowledges these General Terms and Conditions vis-à-vis the hotel, they apply to the contractual relationship between the hotel and the booking partner.
The provisions of these General Terms and Conditions that pertain to the use of hotel services, conduct within the hotel, and the safety and security of hotel operations apply to the guest, regardless of whether the reservation is made directly by the guest or through a booking partner.
For bookings made through external booking channels, the terms and conditions of the respective booking channel explicitly stated at the time of booking also apply. In the event of any conflicts, the terms and conditions explicitly agreed upon for the specific booking shall take precedence.
Deviating Agreements
Individual agreements between the hotel and the respective contracting party take precedence over these General Terms and Conditions.
This applies in particular to individually agreed terms, room quota agreements, framework agreements, and special payment, cancellation, or booking conditions with tour operators, travel agencies, travel brokers, or other business partners.
Deviations from these General Terms and Conditions are binding only if they have been expressly confirmed by the hotel or otherwise agreed upon between the hotel and the contracting party.
Regardless of this, the provisions of these General Terms and Conditions that pertain to the use of hotel services, conduct within the hotel, and the safety and security of hotel operations apply to the guest, unless otherwise agreed.
General Provisions
Conclusion of the Contract
An accommodation contract is concluded as soon as the hotel provides binding confirmation of the reservation or the reservation has been bindingly completed through a booking or distribution channel accepted by the hotel.
For online bookings, the accommodation contract is concluded upon the successful completion of the booking process. The subsequent booking confirmation serves to confirm the reservation that has already been made.
The hotel’s contractual partner is the person or company that makes the binding reservation and enters into the accommodation contract with the hotel. For bookings made through tour operators, travel agencies, travel brokers, or other business partners, the respective booking partner is generally the hotel’s contractual partner, unless otherwise agreed.
Until a binding confirmation is issued, the hotel reserves the right to allocate rooms and facilities that have been provisionally requested or reserved to other guests.
If a person makes a reservation on behalf of another contracting party, that person confirms by making the reservation that they are authorized to do so. To the extent that they expressly commit to assuming contractual obligations toward the hotel, they are liable for these obligations to the agreed extent.
The hotel reserves the right to correct obvious errors, in particular printing, calculation, pricing, or transmission errors. The hotel will inform the contracting party of such corrections as early as possible.
Special requests, non-binding requests, reservations subject to special conditions, and verbal side agreements are binding only if they have been expressly confirmed by the hotel or otherwise agreed upon. A special request that has not been expressly confirmed does not entitle the guest to a specific room location, amenities, or other services.
Prices and Payment
All prices are quoted in Swiss francs (CHF) and include the applicable statutory value-added tax, if any. The prices stated at the time of booking or in the reservation confirmation shall apply, unless expressly agreed otherwise.
For direct bookings, a deposit of 50% of the total price is required, unless a different payment arrangement was agreed upon in the reservation confirmation.
For direct bookings during the winter season, the deposit is due no later than 60 days before arrival; for direct bookings during the summer season, it is due no later than 30 days before arrival. For bookings made within the respective deposit period, the deposit of 50% of the total price is due immediately after booking. The payment deadlines specified in the reservation confirmation are decisive.
For bookings made through tour operators, travel agencies, travel brokers, or other business partners, the payment and billing terms agreed upon with the respective contractual partner apply. These terms take precedence over the provisions herein.
Unless otherwise agreed, the deposit must be paid by bank transfer. The relevant payment information will be provided to the contracting party with the reservation confirmation.
The balance may be paid prior to arrival by bank transfer or on site in cash or using payment methods accepted by the hotel, unless a different payment arrangement has been agreed upon.
Any additional services purchased during the stay will be billed separately and must be paid no later than upon departure.
Any bank or transfer fees shall be borne by the contracting party or the guest, to the extent permitted by the respective payment method and in accordance with applicable laws.
The hotel is entitled to subsequently charge outstanding and contractually owed amounts, as well as damages demonstrably caused by the guest or the contracting party and any resulting costs, to the payment method specified or on file by the contracting party or guest, to the extent permitted by law.
Visitor’s Taxes and Local Fees
The legally required visitor’s taxes and other municipal levies, in particular lodging taxes and tourism promotion fees, are not included in the agreed-upon room or package rate, unless expressly stated otherwise in the reservation confirmation or in an agreement reached with the contracting party.
Depending on the agreement, the corresponding charges will be billed separately to the guest or the contracting party. The amount of the charges is determined by the statutory provisions in effect at the time of the stay and the applicable decrees of the relevant municipality or authority. In particular, different rates may apply to adults and children.
The guest or the contracting party is obligated to provide the hotel, upon arrival or upon request, with all information necessary for the correct recording and billing of tourist taxes, truthfully and in full. This includes, in particular, the number and ages of the accompanying persons.
Once the visitor’s taxes have been recorded and billed, the hotel will issue the guest an official guest card, provided that the guest is entitled to one under the applicable regulations. The services and benefits associated with the guest card are governed by the applicable regulations of the destination.
Changes to statutory taxes will be taken into account in accordance with the applicable legal provisions.
Delayed Payment
If contractually owed payments—in particular down payments or advance payments—are not made by the due date, the hotel may demand payment from the contracting party and, if necessary, grant a reasonable grace period.
If a payment due remains outstanding despite a demand or the granting of a grace period, the hotel is entitled to cancel the reservation or withdraw from the contract. However, the hotel is not obligated to cancel a reservation solely on the basis of a late payment without first issuing a demand or making contact.
In this case, the hotel reserves the right to assert all contractual and statutory claims. Any contractually agreed cancellation fees remain subject to this provision.
For last-minute bookings, the deposit owed in accordance with Section 2.2 is due immediately upon booking. If payment is outstanding, the hotel may contact the contracting party and request payment.
Special Conditions and Notes
Cribs
Cribs, including fitted sheets, are provided free of charge for children up to the age of 2.
The crib must be requested in advance and noted in the reservation confirmation. A maximum of one crib is available per room.
Bedding and Towels
Bedding and towels are provided free of charge by the hotel and are included in the agreed-upon price.
If the guest chooses not to use the bed linens or towels provided by the hotel, there is no entitlement to a price reduction or refund.
No Smoking
All indoor areas of the hotel, particularly the guest rooms, are non-smoking areas. Smoking is not permitted in these areas.
Smoking is permitted on the balconies and in the designated outdoor areas of the hotel, provided that it does not unreasonably disturb other guests, employees, or hotel operations.
The ashtrays provided by the hotel must be used for cigarette butts and other tobacco waste. Cigarette butts may not be discarded on the floor or in flowerpots, planters, or other areas not designated for this purpose.
In the event of a violation of the indoor smoking ban, the guest may be charged for the actual and verifiable costs incurred for cleaning, odor removal, and any necessary special measures. The guest is liable, within the scope of statutory provisions, for any damage or additional cleaning costs resulting from the improper disposal of cigarette butts.
Pets / Dogs
Bringing and keeping pets, especially dogs, is not permitted in the hotel rooms or in the other indoor areas of the hotel.
Dogs are generally welcome in the restaurant. We ask guests who wish to bring their dog to the restaurant to notify us of this, if possible, at the time of reservation or prior to their visit so that we can prepare the appropriate seating arrangements.
Dogs must be kept under control at all times in the restaurant so as not to disturb other guests, staff, or hotel operations. Guests must follow the instructions of the hotel staff.
This policy is subject to mandatory legal provisions, in particular the applicable regulations regarding access and admission of recognized service dogs and guide dogs. Guests are asked to inform the hotel that they will be bringing such a dog, if possible, before making a reservation, so that the necessary organizational arrangements can be made.
In the event of a willful violation of the prohibition against bringing pets into hotel rooms or into indoor areas of the hotel not designated for that purpose, the hotel is entitled, in accordance with statutory provisions, to exclude the guest from further stay or use of the hotel and to terminate the accommodation contract prematurely, provided this is justified by the circumstances.
All actual and verifiable costs incurred as a result of a violation of this provision—in particular for additional cleaning, odor removal, removal of pet hair, or repair of damage to furniture and furnishings—may be charged to the contracting party or guest.
Check-in
Check-in is available on the day of arrival starting at 2:00 p.m.
In the event of early arrival, luggage may be stored at the hotel if possible. There is no entitlement to early check-in unless this has been expressly agreed upon.
The front desk is unstaffed after 10:00 p.m. Arrival after 10:00 p.m. is possible upon prior notification to the hotel. In this case, the guest will be provided with the necessary key card for the hotel room or access to the hotel. Regular check-in and the required registration must be completed at the front desk the following day.
The guest is personally responsible for checking the operating hours and schedules of the shuttle trains, as well as any other transportation connections required for the journey.
A delayed arrival due to traffic delays, missed or canceled transportation connections, or other circumstances within the guest’s control generally does not entitle the guest to a reduction in the agreed-upon price. The applicable cancellation and refund policies remain in effect.
The guest agrees to treat the hotel room provided to them, as well as the inventory and furnishings therein, with care and in accordance with their intended use.
Any defects or damage to the hotel room or its furnishings must be reported to the hotel immediately upon discovery.
The guest is liable, within the scope of statutory provisions, for damage culpably caused by the guest, their traveling companions, visitors, or persons invited by the guest.
The hotel room may not be occupied by more people than agreed upon in the reservation confirmation. Children and infants are counted toward the maximum permitted occupancy unless expressly agreed otherwise.
In the event of unauthorized over-occupancy, the hotel is entitled to refuse admission to excess guests and/or to charge for the additional services actually used at the applicable rates.
Check-out
The hotel room must be vacated by 11:00 a.m. at the latest on the day of departure.
A later checkout is only possible by prior arrangement with the hotel. Unless a later checkout has been expressly agreed upon, the hotel may vacate the room as of 11:00 a.m. to prepare it for the next guests.
In the event of an unagreed late checkout, the hotel is entitled to charge for the actual, verifiable additional costs incurred as a result.
After check-out, the guest’s luggage may be temporarily stored at the hotel, if possible and in accordance with the hotel’s instructions. There is no entitlement to a specific storage period or to long-term luggage storage.
The room must be left in a clean and orderly condition. All keys, room cards, or other means of access provided to the guest must be returned upon departure in accordance with the hotel’s instructions.
For lost or unreturned keys, room cards, or other means of access, the hotel may charge the guest for the actual, verifiable replacement or consequential costs incurred.
Lost and Found
Items found in the hotel will, as far as possible, be clearly identified as belonging to their respective owners and kept for a reasonable period of time.
Lost and found items will generally be forwarded only at the guest’s request and to the delivery address provided by the guest. The guest is responsible for providing the delivery address completely and correctly.
The forwarding of letters and small items within Switzerland is generally free of charge.
For larger or bulky items, as well as for shipments abroad, the guest is responsible for the actual shipping costs incurred. The hotel may require advance payment of shipping costs for such shipments.
After the reasonable retention period has expired, the hotel is entitled to dispose of the lost property in accordance with statutory provisions.
The hotel assumes no liability for loss, damage, or delays during postal or transport delivery beyond the liability required by law.
Cancellation and Withdrawal from the Contract by the Guest
Cancellation by Individual Guests
If a guest is unable to begin a stay booked directly with the hotel, the hotel must be notified immediately in writing, particularly by email.
The time of receipt of the cancellation notice by the hotel shall determine compliance with the cancellation deadline.
The complete cancellation of a reservation, as well as a reduction in the number of guests or the length of stay, is considered a full or partial cancellation, respectively, and will be billed in accordance with the following cancellation terms.
The package price is defined as the total price of the hotel services booked directly with the hotel, as stated in the reservation confirmation, unless otherwise agreed upon below or in the reservation confirmation.
The following cancellation terms apply to direct bookings by individual guests. For bookings made through external booking channels, tour operators, travel agencies, travel brokers, or other business partners, the terms agreed upon for each case shall apply in accordance with the relevant provisions of these General Terms and Conditions or the reservation confirmation.
Winter – Direct Bookings
The following cancellation conditions apply to bookings made directly with the hotel by individual guests during the winter season:
- Up to 60 days before arrival: free of charge
- 59 to 43 days before arrival: 40% of the package price
- 42 to 29 days before arrival: 60% of the package price
- 28 to 15 days before arrival: 80% of the package price
- 14 to 0 days before arrival: 100% of the package price
- In case of a no-show: 100% of the package price
- In case of early departure: 100% of the package price
In the event of a partial cancellation—in particular, a reduction in the number of guests or the length of stay—cancellation fees will be calculated based on the portion of the package price affected by the change.
Cancellation fees will be charged only to the extent that the services canceled by the guest cannot be sold or re-rented to another party. If the hotel is able to resell the rooms, nights, or other services canceled by the guest, the cancellation fee will not apply to the portion that has been resold.
In the event of early departure, any nights or services not yet utilized will be treated in accordance with the principles set forth above. To the extent that the hotel is able to sell or re-rent the relevant rooms or services for the remaining period, no cancellation fees will be charged for them.
For services from external providers booked as part of the reservation—in particular ski tickets—the respective cancellation and refund policies of the service provider apply. If the service provider grants no refund or only a partial refund, the contracting party shall bear the corresponding costs or the non-refunded amount.
Summer – Direct Bookings
The following cancellation terms apply to bookings made directly with the hotel by individual guests during the summer season:
- Up to 30 days before arrival: free of charge
- 29 to 15 days before arrival: 30% of the package price
- 14 to 8 days before arrival: 50% of the package price
- 7 to 0 days before arrival: 100% of the package price
- No-show: 100% of the package price
- In case of early departure: 100% of the package price
In the event of a partial cancellation—particularly a reduction in the number of guests or the length of stay—cancellation fees will be calculated exclusively on the portion of the package price affected by the change.
For services from external providers booked as part of the reservation—in particular, mountain rail tickets—the respective cancellation and refund policies of the service provider apply. If the service provider grants no refund or only a partial refund, the contracting party shall bear the corresponding costs or the non-refunded amount.
Bookings Made Through Traditional Online Booking Platforms
For bookings made through external booking channels—in particular Booking.com, Feratel, or similar booking platforms—the payment, cancellation, and booking terms displayed on the respective platform at the time of booking and accepted by the guest generally apply.
These terms also apply if the guest contacts the hotel directly after the booking has been made. Changes or cancellations of a reservation made through a booking platform are generally governed by the terms and conditions of the respective booking platform applicable to that reservation.
If the existing reservation is properly canceled through the booking platform and a new reservation is subsequently made directly with the hotel, this constitutes a new, separate reservation. The hotel’s currently valid Terms and Conditions and cancellation policy apply to this direct booking.
A reservation made through a booking platform is not automatically transferred or converted into a direct booking. Such a change requires the hotel’s express consent.
In the event of any conflict between the booking platform’s terms and conditions applicable to the original booking and these General Terms and Conditions, the specifically agreed-upon terms and conditions of the booking platform shall take precedence for that original booking.
Group Reservations
Reservations for 10 or more people are considered group bookings, unless otherwise agreed.
If a group is unable to begin its booked stay or if the number of guests or the length of stay is to be reduced, the hotel must be notified immediately in writing.
Unless different terms were agreed upon in the reservation confirmation, the following cancellation terms apply to group bookings:
- Up to 60 days before arrival: free of charge
- 59 to 30 days before arrival: 50% of the package price
- 29 to 15 days before arrival: 80% of the package price
- 14 to 0 days prior to arrival: 100% of the package price
- No-show: 100% of the package price
- In case of early departure: 100% of the package price
Individual reductions of up to two rooms may be made free of charge up to 30 days prior to arrival, provided the remainder of the group reservation remains in effect. This rule applies regardless of the amount of the original package price.
In the event of a partial cancellation—particularly a reduction in the number of guests or the length of stay—cancellation fees will be calculated exclusively on the portion of the package price affected by the change.
Cancellation fees will be charged only to the extent that the rooms, nights, or other services canceled or not utilized by the guest or group cannot be sold or re-rented to others. If the hotel is able to sell the relevant services to other guests, the cancellation fee for the portion that has been resold will be waived.
In the event of a complete cancellation by the group, the above cancellation deadlines and rates apply to the entire package price affected by the cancellation.
In the event of early departure, any nights or services not yet utilized will be treated in accordance with the principles set forth above.
The hotel may charge a processing fee of CHF 50.00 for handling a complete group cancellation. This processing fee is in addition to any cancellation charges.
Services provided by external service providers will be billed in accordance with their respective cancellation and refund policies, to the extent that the service provider does not issue a refund or issues only a partial refund.
Reduction, Late Arrival, and Early Departure
A reduction in the number of guests, the length of stay, or the booked services is considered a partial cancellation of the reservation.
In the event of a late arrival, a reduction in the length of stay, or an early departure, the services not utilized will be handled in accordance with the cancellation terms applicable to the respective reservation. A late arrival generally does not result in a reduction of the agreed-upon price.
Cancellation fees will be charged only to the extent that the rooms, nights, or other services not utilized by the guest cannot be sold or sublet to others.
If the hotel is able to sell or re-rent the relevant services for the originally booked period to another party, the cancellation fee for the portion that has been resold will be waived.
The hotel is not obligated to guarantee that the rooms will be rented or resold to another party. A voluntary reduction or waiver of cancellation fees by the hotel does not entitle the guest to similar treatment for future bookings.
Change of Dates
A change to the travel date generally constitutes a change to the existing reservation and requires the hotel’s approval.
A change of dates may be granted subject to availability and in accordance with the cancellation terms applicable to the original reservation. The hotel decides on a case-by-case basis whether and under what conditions a change of dates is possible.
If a date change is confirmed by the hotel, the reservation will be transferred to the new date. The original booking terms generally remain in effect unless otherwise agreed upon with the hotel.
In individual cases, the hotel may, as a gesture of goodwill, accommodate the guest and allow a change of dates or other adjustments to the reservation that deviate from these terms and conditions. Such accommodation is provided voluntarily and does not establish a right to similar treatment for future reservations.
If the hotel is unable or unwilling to confirm the requested date change, the original reservation remains in effect and may only be canceled in accordance with the cancellation terms applicable to that reservation.
A new booking made independently for a different period is considered a new reservation. The prices, terms, and cancellation policies in effect at the time of the new booking apply to this reservation.
Cancellation Insurance:
The hotel recommends purchasing cancellation or travel insurance.
It is the guest’s responsibility to purchase such insurance. Such insurance can cover the financial consequences of a cancellation, late arrival, or early departure, particularly in the event of illness, accident, or other unforeseen circumstances.
Whether or not insurance is purchased has no effect on the hotel’s contractually applicable cancellation terms.
Liability and Duty of Care
Guest’s Liability for Damage
The guest agrees to use the hotel room, its furnishings, and the hotel’s other facilities with care and in accordance with their intended purpose.
The guest is liable, within the scope of statutory provisions, for damages culpably caused by the guest, the guest’s traveling companions, visitors, or persons invited by the guest.
Any damage or defects discovered must be reported to the hotel immediately.
The hotel is entitled to charge the guest for any damage that has been proven to have occurred and is attributable to the guest, as well as for the necessary and reasonable costs of repairing such damage.
Personal Belongings and Valuables
The hotel’s liability for items brought in by the guest is governed by statutory provisions, in particular the provisions of the Swiss Code of Obligations regarding the liability of innkeepers.
Special statutory provisions apply to cash, jewelry, securities, and other valuables.
The hotel recommends that guests do not leave valuables or large sums of money unattended in their hotel room or in other publicly accessible areas. A hotel safe is available in the hotel room for the secure storage of valuables.
Liability for Personal Belongings
Guests are generally responsible for the careful safekeeping of their personal belongings.
Special provisions as set forth in Section 5.3 apply to personal belongings that the guest brings into or leaves behind in the wellness area.
The hotel’s liability for personal belongings outside the wellness area is governed by statutory provisions. The hotel is not liable for damage or loss culpably caused by the guest, their traveling companions, accompanying persons, visitors, or persons invited by the guest, to the extent permitted by law.
Mandatory statutory liability provisions remain reserved.
Force Majeure and Unforeseeable Events
The hotel is not liable for disruptions, delays, or restrictions resulting from events beyond its reasonable control and for which the hotel is neither responsible nor at fault.
These include, in particular, natural disasters, fire, water damage, or damage caused by natural forces; official orders; war; acts of war; strikes; significant traffic disruptions; and interruptions in the supply of energy, water, or other utilities, to the extent that these events substantially impair or render impossible the provision of the contractually agreed-upon services.
If, due to such an event, the hotel is forced to cancel the reservation before the start of the stay, any payments already made for hotel services not rendered will be refunded.
If, after the stay has begun, it cannot be continued or can only be continued in part due to such an event, amounts already paid for hotel services not rendered will be refunded accordingly.
Further claims, in particular for reimbursement of travel, transportation, lodging, rebooking, or other consequential costs, shall exist only to the extent that the hotel is legally liable for such costs.
Use of the Wellness Area
General Information
Use of the wellness area is at the guest’s own risk and subject to compliance with the applicable usage, hygiene, and safety regulations.
The wellness area is generally available to hotel guests during the hours of operation set by the hotel. The applicable hours of operation will be communicated to the guest in an appropriate manner.
External guests may use the wellness area for a fee following a prior reservation and subject to availability as part of a Private SPA package offered by the hotel. There is no entitlement to access or to a specific time slot.
Access to the wellness area is generally permitted for individuals 16 years of age or older. Individuals 14 years of age or older may use the wellness area when accompanied by a parent.
The wellness area is designated as a nude zone. The sauna and steam room must be used without swimwear. The bathrobes provided by the hotel must be worn outside the wet and sauna areas in accordance with the hotel’s guidelines.
The hotel reserves the right to temporarily restrict access to or close the wellness area for operational, technical, safety-related, or other objectively justified reasons.
Use and Safety
The facilities in the wellness area—in particular the sauna, steam room, Kneipp foot bath, relaxation room, and sensory shower—must be used for their intended purposes and in compliance with the applicable usage, hygiene, and safety regulations.
The wellness, usage, and safety rules posted by the hotel or otherwise communicated, as well as the instructions of the hotel staff, must be followed at all times.
For hygienic reasons, guests must shower and thoroughly dry off before using the sauna and steam room. In the sauna and steam room, the towels provided for this purpose must be used in accordance with the hotel’s hygiene guidelines.
The recommended duration of stay and usage times, as well as the guidelines for cooling down and recovery, must be followed. The facilities may only be used for their intended purpose and in accordance with the respective instructions. Improper or abusive use is not permitted.
Guests must be considerate of others throughout the entire wellness area. In particular, guests must refrain from making disruptive noise, engaging in inappropriate behavior, or using the facilities in any way that could endanger, disturb, or significantly inconvenience other guests.
Persons who, due to their health condition or other personal circumstances, are not suited to use certain facilities must refrain from using them. If you have any health concerns, it is recommended that you seek medical advice in advance.
The hotel reserves the right to temporarily restrict access to individual facilities or to take them out of service if necessary for operational, technical, hygienic, or safety-related reasons.
Liability
Use of the wellness area and its facilities is at your own risk and must comply with the applicable usage, hygiene, and safety regulations.
The hotel is liable for personal injury and property damage related to the use of the wellness area within the scope of statutory provisions. Liability for damage caused by improper, abusive, or non-compliant use of the facilities by the guest is excluded to the extent permitted by law.
The statutory liability provisions apply to personal belongings that guests bring into or leave behind in the wellness area. The hotel strongly recommends that guests do not bring valuables, large sums of money, or other precious items into the wellness area, but instead store them in the hotel safe in their room.
The guest is liable, within the scope of statutory provisions, for damage caused by intentional or negligent conduct to the hotel’s facilities, furnishings, or other property.
In the event of gross or repeated violations of the rules of use, hygiene, or safety, the hotel may exclude the guest in question from further use of the wellness area.
In the event of exclusion, no refund will generally be issued for wellness services already paid for, provided the exclusion is due to the guest’s culpable conduct.
Mandatory statutory liability provisions remain reserved.
Conduct and House Rules
Consideration and House Rules
The guest agrees to show consideration for other guests, employees, and the hotel’s facilities and proper operation.
Appropriate and considerate behavior must be maintained throughout the hotel premises. In particular, disruptive or excessive noise, aggressive or inappropriate behavior, and the harassment or endangerment of other guests or employees must be avoided.
The following house rules apply in particular:
- Quiet hours are from 10:00 p.m. to 7:00 a.m. During this time, guests must be especially considerate of others and avoid making noise.
- Parties, celebrations, and similar events are not permitted in the hotel rooms.
- The hotel’s furniture, facilities, and furnishings must be treated with care and used as intended.
- The use of open flames, candles, and cooking or heating appliances in hotel rooms is not permitted. Exceptions are appliances provided by the hotel, such as electric kettles and coffee makers.
- Sports and winter sports equipment, in particular skis, ski boots, snowboards, and sleds, may not be brought into, stored in, or used in hotel rooms. The designated ski storage room is available for this purpose.
- Smoking in the hotel is subject to the special provisions set forth in Section 2.5.3.
Guests must comply with the hotel’s additional house rules, as well as safety and usage regulations.
Guests must follow the instructions of the hotel staff to the extent that they serve the safety and protection of other guests and employees or the proper operation of the hotel.
Violations of the House Rules
In the event of significant or repeated violations of the house rules, safety regulations, or these General Terms and Conditions, the hotel may take appropriate measures.
Depending on the nature and severity of the violation, the hotel may, in particular, issue a warning to the guest, exclude the guest from certain facilities or services, terminate the lodging agreement prematurely, or expel the guest from the premises, provided this is justified by the circumstances and permitted by law.
This applies in particular in cases of significant harassment or endangerment of other guests or employees, in cases of intentional or grossly negligent damage to hotel property, repeated violations of the smoking ban, significant disturbance of the peace, or other serious violations of the house rules or safety regulations.
In the event of early termination of the stay due to a culpable violation by the guest, the hotel reserves the right to assert claims arising from the contract as well as claims for compensation for actual damages incurred.
Behavior in Case of Fire and Fire Alarms
In every hotel room, there is an information sheet on the back of the room door containing important instructions on what to do in case of fire, as well as details on escape routes and the assembly point.
Upon arrival, the guest is required to familiarize themselves with the escape routes, emergency exits, and the safety information posted in the hotel room.
In the event of a fire alarm or a fire, guests must immediately and fully comply with the instructions of the hotel staff as well as those of the fire department, police, or other emergency responders.
In the event of a fire, guests must leave the hotel room immediately. They must use the marked escape routes and emergency exits. Elevators must not be used in the event of a fire.
Escape routes, emergency exits, and doors leading to escape and rescue routes must not be blocked or otherwise obstructed.
In the event of an evacuation of the hotel, the guest must proceed to the assembly point designated by the hotel and follow further instructions from the hotel staff or emergency responders.
It is prohibited to activate a fire alarm or fire detector without a valid reason.
Data Protection
The hotel processes the personal data of the contracting party and the guest in accordance with applicable data protection regulations.
Personal data is processed, in particular, for the purpose of making and processing reservations and lodging contracts, providing the booked services, processing payments, and fulfilling legal obligations.
Further information regarding the processing of personal data, the purposes and legal bases for data processing, the recipients of data, and the rights of data subjects is contained in the hotel’s current privacy policy.
The current privacy policy is available in an appropriate format, in particular on the hotel’s website.
Final Provisions
Governing Law
Swiss law applies to the contractual relationship between the hotel and the contracting party or guest, subject to mandatory statutory provisions
Jurisdiction
For disputes arising from or in connection with the contractual relationship, the places of jurisdiction provided for by law shall apply.
Mandatory statutory jurisdictions are reserved.
Severability Clause
Should any provision of these General Terms and Conditions be or become wholly or partially ineffective, invalid, or unenforceable, the validity of the remaining provisions shall remain unaffected.
To the extent permitted by law, a provision that comes as close as possible to the economic purpose of the original provision shall be deemed agreed upon in place of the invalid, void, or unenforceable provision.
